The stakes on a Form 12A changed.

A FORM 12A certifies that the inspection, maintenance and reporting procedures in a compliance schedule were fully complied with over the previous twelve months. It is not a formality and it has not been treated as one since 2023.

The Building Act carries a specific offence for certifying compliance that did not occur: a maximum of NZD 50,000 for an individual and NZD 150,000 for a body corporate.

Following the Loafers Lodge fire of May 2023, in which five people died, four people are facing manslaughter charges with trial set for 2026, on the police allegation that each was responsible for aspects of the building's fire safety systems. Legal commentary on the subsequent reform noted that the driving concern was Form 12As issued where they should not have been, through negligence rather than knowledge.

Your registration is held council by council, for the specific specified systems you are competent in, and the council verifies it against every Form 12A you file.

None of that is an argument for signing less. It is an argument for being able to show your work.

If you endorse fire safety measures in NSW, the February 2026 amendments tightened the ground under you: AS 1851-2012 routine servicing became mandatory, signing was restricted to NSW accredited practitioners, and records must now be digitally tracked, accessible, and retained for a minimum of seven years. From February 2027 the accreditation requirement extends further, to newly installed measures.
