What you are actually holding

Under the Health and Safety at Work Act 2015 you are a PCBU, and your officers hold a personal due diligence duty that includes verifying that safety processes are provided and used. Duties overlap and cannot be contracted away.

Under HSWA s29, insurance against a fine is unlawful. Reckless conduct exposing a person to risk of death or serious injury carries a maximum of NZD 3,000,000 for a body corporate and NZD 600,000 or five years imprisonment for an officer.

Under the Building Act, failing to comply with a notice to fix carries a maximum of NZD 200,000 plus NZD 20,000 for every day it continues.
